Article 1: General Provisions

The e-commerce website of Designed4you, a Business Unit of Designconsulting BV (hereinafter “Designed4You”) offers its clients the opportunity to purchase articles from its web store online.

The present General Terms and Conditions (“Terms and Conditions”) apply to any order placed by a visitor to this website (hereinafter “customer”) of articles on the web store. When placing an order through Designed4You’s webstore, the Customer must expressly accept these Terms, thereby agreeing to the applicability of these Terms to the exclusion of all other terms and conditions. Additional terms and conditions of the Customer are excluded, except when previously, in writing and expressly accepted by Designed4You.

 

Article 2: Price

All prices mentioned are indicated in EURO and always include VAT and all other compulsory charges or taxes to be paid by the customer.

If delivery, reservation or administrative costs are charged, this will be stated separately.

The price mentioned refers exclusively to the articles as described word for word. The accompanying photos are for decorative purposes only and may contain elements that are not included in the price.

 

Article 3: Offer

Despite the fact that the online catalog and web store are composed with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer are not binding to Designed4You. Designed4You is regarding the accuracy and completeness of the offered information only bound by a means obligation. Designed4You is in no way liable for obvious material errors, misprints or printing errors.

If the customer has specific questions about e.g. sizes, color, availability, delivery time or delivery method, we request the customer to contact us in advance by email.

The offer is always valid while supplies last and can be modified or withdrawn by Designed4You at any time. Designed4You cannot be held responsible for the unavailability of an article. If an offer has a limited duration or subject to conditions, this is explicitly stated in the offer.

The offer of the web store does not extend to custom made products.

 

Article 4: Order

To place an order, the customer must add the item to his/her shopping cart. The customer can choose the quantity he/she wishes to order of the item. Next, the customer will have to fill in his/her customer information, choose the delivery method and payment method.

Before clicking through to the payment page, the customer accepts the terms and conditions.

By clicking on “order with payment obligation”, the customer places a binding order for the items in the shopping cart and enters into an obligation to pay for them. The purchase contract is concluded.

After the order is placed, the customer receives the order confirmation by email without delay.

 

Article 5: Payment

Payment is only possible with a normal bank card.

For customers from the Netherlands there is also the possibility of iDeal. If the payment fails, Designed4You are entitled to refuse the order.

 

Article 6: Delivery and execution of the contract

After the order is confirmed by Designed4You and paid for by the customer, the order is prepared, packaged and delivered via courier service Mikropakket and this within 10 working days after payment of the order.

The delivery costs are at the expense of the client and are charged separately.

Items ordered through this web store are delivered in Belgium, the Netherlands and / or Luxembourg. For delivery in Belgium the delivery costs are € 10.00, for delivery in the Netherlands or Luxembourg € 14.00.

Unless otherwise agreed or expressly provided, the goods will be delivered to the customer’s home within 10 working days following receipt and payment of the order.

Any visible damage and/or defect of an article or any other shortcoming in the delivery, has to be reported by the client to Designed4You immediately and in writing by email and this within 24 hours after receipt. The client must always mention the order number and a clear description of the damage, accompanied by photos that clearly show the damage.

The risk of loss or damage shall pass to the customer from the moment the articles are delivered to the address provided by the customer or to a third party designated by the customer.

 

Article 7: Reservation of ownership

The delivered articles remain the exclusive property of Designed4You until complete payment by the customer.

The customer agrees to inform third parties of Designed4You’s reservation of ownership, if necessary,

e.g. to any person who might come to seize articles not yet paid for in full.

 

Article 8: Right of withdrawal

8.1.
In case of a consumer purchase, the customer has the right to withdraw from the agreement within a period of 14 calendar days after the day on which the customer receives physical possession of the article, without giving reasons.

To exercise the right of withdrawal, the customer must inform Designed4You of his decision to withdraw from the agreement by an unequivocal statement in writing (by post: DesignConsulting BV, Ten Moortele 38, 2811 Leest)

To comply with the withdrawal period, the customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.

The customer must return the items by registered mail without delay, but in any case no later than 14 calendar days after the day on which he communicated his decision to revoke the agreement to Designed4You. The customer is on time if he returns the articles before the period of 14 calendar days has expired.

The direct cost of returning the articles shall be paid by the customer.

The Customer must return the items in their original condition and packaging, unworn with all accessories included. Only items that are in their original packaging, along with all accessories, and invoice or proof of purchase can be returned.

The customer may try on the article in a way that is necessary to evaluate the article. If Designed4You receives the returned item back and finds that there is visible damage or wear, Designed4You will reduce this damage to the purchase price and refund only the residual value.

 

8.2.
If the customer withdraws from the Agreement, Designed4You shall refund all payments received from the customer up to that point, including standard delivery charges, within a maximum of 14 calendar days after Designed4You has received all the goods back, or until the customer has demonstrated that he has returned the goods, whichever comes first.

If the customer has purchased multiple items and only wishes to return a part of it, Designed4You will only refund the purchase price of the returned item.

Any additional costs resulting from the customer’s choice of a mode of delivery other than the cheapest standard delivery offered by Designed4You will not be refunded.

Designed4You shall reimburse the customer using the same means of payment with which the customer made the original transaction, unless the customer has expressly agreed otherwise; in any case, the customer shall not be charged for such reimbursement.

 

Article 9: Guarantee

The legal guarantee period of 2 years starts from the delivery of the goods to the customer.

In order to make a claim under the guarantee, the customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.

In the event of a defect being detected, the customer shall inform Designed4You as soon as possible by email. In any case, each defect has to be reported within 2 months after its detection by the Client. Afterwards, any right to repair or replacement becomes null and void.

The guarantee never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, adaptations or modifications to the article, heavy- handed use, poor maintenance, water damage or any other abnormal or incorrect use.

Defects that become apparent after a period of 6 months following the date of delivery are not considered to be hidden defects, unless the customer can prove otherwise.

The guarantee is invalidated if repairs are carried out by third parties or by the customer himself.

 

Article 10: Privacy

The personal data of the customer are registered in the customer file of Designed4You.

Article 13: Nullity

If any provision of these general terms and conditions is declared invalid, unlawful or void, this shall not in any way affect the validity, lawfulness and applicability of the other provisions. The other terms and conditions shall in that case continue to apply in full.

The absence at any time by Designed4You to enforce any of the rights listed in these conditions, or exercise any of them, shall never be seen as a waiver of such provision and shall not affect the validity of these rights.

 

Article 14: Amendment of general terms and conditions

Designed4You reserves the right to amend the general terms and conditions at any time. The amended general terms and conditions are available to customers on the website at all times.

 

Article 15: Proof

The customer accepts that electronic communications and backups may serve as evidence.

 

Article 16: Applicable law and competent court

The relationship between Designed4You and the customer is governed by Belgian law, with the exception of the provisions of private international law on applicable law.

For the settlement of possible disputes resulting from this relationship, only the courts of Mechelen are competent.
